[Regulatory Update] ECHA advances technical assessment of the universal PFAS restriction proposal — focus turns to use-specific substitution assessments for electronics, semiconductors and other sectors
Source:European Chemicals Agency (ECHA)
On 26 March 2026, ECHA published RAC's final opinion and SEAC's draft opinion on the universal PFAS restriction proposal. RAC's final opinion supports a broad restriction. SEAC's draft opinion considers EU-wide action necessary, while supporting derogations only where suitable alternatives are not available, and it has not yet concluded on the proportionality of some of RAC's proposed risk management measures. The deadline for public consultation on the SEAC draft is 25 May 2026.
The assessment is being carried out use by use, covering sectors such as electronics and semiconductors, medical devices, transport, energy, and food-contact materials. The exemptions and their conditions remain at the assessment stage and have not yet been finalised as EU law.
Editor's View
In PFAS regulation, what matters is not simply "whether to ban PFAS," but whether substitute technologies exist for each use, and what conditions would be required — this is at the centre of the regulatory design. Electronics and semiconductor companies need to identify not just where PFAS is used but, use by use, whether substitutes exist, how long a transition would take, and the impact on product certification; a universal restriction is not a blanket ban, and its impact on companies will be determined around "substitutability by use."
