[Regulatory Update] US EPA moves to rescind and reconsider drinking-water rules for PFHxS, PFNA, GenX and PFBS — plans to keep PFOA/PFOS standards in place

On 18 May 2026, the EPA published a proposed rulemaking to rescind and reconsider the regulatory determinations and drinking-water rule for PFHxS, PFNA, HFPO-DA (GenX), and Hazard Index mixtures combining these three with PFBS. The EPA cites consistency with procedures under the Safe Drinking Water Act as the reason for reconsideration. For PFOA and PFOS, by contrast, the EPA has indicated it intends to keep the Maximum Contaminant Levels (MCLs) in place, and this should not be conflated with the reconsideration of the other four substances/mixtures. It should also be noted that the 18 May action is a proposed rule and does not by itself mean final rescission has already taken effect.
Editor's View

US PFAS regulation is not monolithic — the regulatory stage differs substance by substance. Companies in the drinking-water sector, and those that discharge or use PFAS, need to check the regulatory status substance by substance rather than assuming, in blanket terms, that "the EPA has withdrawn PFAS regulation"; because the regulatory direction differs even within the single category of PFAS, companies should avoid managing compliance at the level of the "PFAS" category alone.
