[UN] UN General Assembly Adopts Resolution Welcoming the ICJ Advisory Opinion on Climate Change — Urging States to Fulfil Their Climate Obligations

Source:United Nations General Assembly (UNGA) / UN press release
On 20 May 2026, the UN General Assembly adopted resolution A/RES/80/263 welcoming the advisory opinion delivered by the International Court of Justice (ICJ) on 23 July 2025 on the obligations of States in respect of climate change. The resolution was adopted by a recorded vote of 141 in favour, 8 against and 28 abstentions. The ICJ advisory opinion sets out, among other things, that States have a duty to prevent significant environmental harm and a duty to cooperate to protect the climate system. The 2026 resolution welcomes the opinion and calls on States to fulfil these obligations. The resolution is addressed to States and does not impose new obligations on companies, including Scope 3 disclosure requirements.
Editor's View

The significance of this development lies not in any new direct obligation for companies under international law, but in the clarification of the international legal basis underpinning national climate policy and regulation. Going forward, the ICJ advisory opinion may serve as a legal and policy reference as States design domestic climate legislation, emissions rules and environmental due diligence requirements, and companies will need to track how shifts in international climate policy are reflected in national rules. Both the ICJ opinion and the General Assembly resolution are directed at States; their impact on companies comes at a "second stage," as they are translated into national laws and policies.
