China Corporate Environmental Information Disclosure Regulations
ENFORCEMENT TIMELINE
Effective February 8, 2022
Overview
The "Corporate Environmental Information Disclosure Regulations," formulated by China's Ministry of Ecology and Environment, are an important set of regulations aimed at promoting corporate environmental compliance. They require companies meeting specific criteria -- such as those exceeding pollutant discharge standards or discharging hazardous waste -- to publicly disclose environmental information (the operating status of pollution prevention facilities, emissions data, environmental administrative penalties, etc.) within statutory deadlines. The regulations aim to strengthen corporate social responsibility (CSR) and ensure transparency, thereby advancing government environmental management and safeguarding the public's right to know. In addition, companies that receive an environmental administrative penalty are subject to an interim reporting obligation requiring disclosure of related information within 10 business days of the event, with local authorities individually designating covered companies as "key pollution supervision and management enterprises."
Enforcement Timeline
- December 22, 2021: The regulations were formally promulgated by the Ministry of Ecology and Environment.
- February 8, 2022: The regulations formally took effect.
- By March 15 each year: Companies are obligated to disclose the prior year's environmental information via the National Corporate Environmental Information Disclosure System.
- Ongoing: Regular administrative review of the accuracy and truthfulness of disclosed information, along with penalties and credit-blacklisting for violating companies.
Business Impact
Locally established entities in China are required to conduct regular monitoring and publish highly transparent data. Importance is also growing from the perspective of ESG investors, making it essential to build an appropriate data management system.
