EU ELV Dismantling and Critical Component Processing Requirements

ENFORCEMENT TIMELINE

Expected phased application from around 2026 under the proposed ELV Regulation

Enforcement: Expected phased application from around 2026 under the proposed ELV Regulation

Overview

The European Commission's proposed new Regulation on End-of-Life Vehicles (the ELV Regulation) would elevate the existing Directive (2000/53/EC) into a strengthened, directly applicable regulation.

These requirements set technical standards and information-disclosure processes obligating Authorized Treatment Facilities (ATFs) to properly remove and treat environmental pollutants from end-of-life vehicles (such as fluids, air-conditioning refrigerants, and lead-acid batteries), and to efficiently and safely dismantle, sort, reuse, and recycle EV batteries, drive motors (containing rare-earth magnets), electronic boards, glass, and plastic components.

Enforcement Timeline

July 13, 2023: The European Commission formally publishes the proposed ELV Regulation.

2024–2025: Deliberation and adoption proceed in the European Parliament and Council.

From 2026: The new Regulation is expected to enter into force, with phased application of requirements such as mandatory digital disclosure of dismantling information for treatment facilities and automakers.

Business Impact

Automakers and Tier 1 component suppliers will be required to adopt structures that consider design for dismantling from the design stage — such as easily separable structures and simplified fastening methods — and to build systems for providing "digital dismantling information" to treatment facilities, specifying the type of rare-earth magnets used in drive motors and battery removal procedures.
