EU WEEE/ELV Mandatory Collection and Recovery Rate Targets by Product Category and Compliance Calculation Practice

ENFORCEMENT TIMELINE

Applied under the WEEE Directive (2012 recast) and the proposed ELV Regulation (2023 revision)

Enforcement: Applied under the WEEE Directive (2012 recast) and the proposed ELV Regulation (2023 revision)

Overview

This card focuses on the specific numerical targets and compliance calculation practice for the 'mandatory collection rates,' 'recycling/reuse rates,' and 'total recovery rates (including energy recovery)' set by product category under the EU Waste Electrical and Electronic Equipment Directive (WEEE Directive: Directive 2012/19/EU) and the End-of-Life Vehicles Regulation (ELV Regulation: Regulation Proposal COM(2023) 451 / Directive 2000/53/EC).

Under Annex III of the WEEE Directive, six product categories (large household appliances, small household appliances, IT and telecommunications equipment, lighting equipment, electrical and electronic tools, and toys/leisure and sports equipment) are subject to Member State-level minimum collection targets based on either the weight placed on the market (65% threshold) or the weight generated (85% threshold), together with recovery targets ranging from 55% to 85% depending on the category. Under the ELV Regulation, vehicles are also subject to strict targets of a minimum 95% 'reuse and recovery' rate and a minimum 85% 'reuse and recycling' rate, calculated against the average weight of an end-of-life vehicle, requiring advanced circular material recovery practices.

Enforcement Timeline

August 15, 2019: The common EU-wide collection target under the WEEE Directive — 65% of the weight placed on the market (or 85% of the weight generated) — takes effect.

2020–ongoing: Member States maintain and report compliance with the ELV Directive's 95% recovery / 85% recycling targets per vehicle average weight.

July 2023: The European Commission publishes its proposed revision to the ELV Regulation (COM(2023) 451), proposing additional targets such as a minimum 25% recycled content requirement for plastics used in vehicles.

June 30 each year: Deadline for Member States to report WEEE/ELV collection and recovery performance data for the year before last to Eurostat.

Business Impact

Electrical and electronic equipment manufacturers (subject to WEEE) and automotive and automotive parts manufacturers (subject to ELV) must carry out quantitative simulations of material- and component-level recycling rates for their products at end-of-life, and provide technical evidence of design for dismantling, in advance. Recycling rate targets differ by WEEE product category (for example, 80% recycling / 85% recovery for large household appliances versus 70% recycling / 80% recovery for small IT equipment), and whether plastics contain brominated flame retardants (BFRs) or similar substances can be a decisive factor in how the recycling rate is calculated.

Organizations operating Extended Producer Responsibility (EPR) schemes in European countries — Producer Responsibility Organisations (PROs) and individual operators — must also verify that the collection and treatment data they submit to national environmental authorities strictly conforms to Eurostat's specified calculation methodology (such as the WEEE calculation rules under Commission Decision 2019/2193). Member States and operators falling short of the targets face fines and additional EPR contribution penalties (eco-modulation), making it essential to optimize plastics resource recovery and metal recovery processes from the product design stage onward.
