JP Water Pollution Control Act — Review of Provisional Effluent Standards for Boron, Fluorine, and Nitrate Nitrogen

ENFORCEMENT TIMELINE

Effective July 1, 2025

Enforcement: Effective July 1, 2025

Overview

This is a review of the provisional effluent standards for boron and its compounds, fluorine and its compounds, and nitrate nitrogen and related substances, which are temporarily applied under the Water Pollution Control Act to certain industries, such as electroplating, glass manufacturing, and metal mining, for which compliance with the general effluent standards is considered technically extremely difficult. The Ministry of the Environment reviews these standards every three years, progressively narrowing the list of covered industries or tightening the provisional standard values (moving them toward the general standard) as effluent treatment technology becomes more widespread.

Enforcement Timeline

July 1, 2022: The current provisional effluent standards take effect (valid for three years).

June 30, 2025: The current provisional effluent standards expire.

July 1, 2025: The revised provisional standards (or transition to the general standards) take effect.

Business Impact

Manufacturers with factories or business sites in Japan that discharge the covered substances in their wastewater need to inspect the treatment capacity of their effluent treatment facilities and, where necessary, expand or revise their equipment. For industries whose provisional standard is removed or tightened, more advanced coagulation-sedimentation, ion exchange, or membrane separation technology may become necessary; businesses that fail to comply and exceed the standard risk a corrective order or a direct criminal penalty.
