U.S. EPA TSCA Section 6 Chrysotile Asbestos (White Asbestos) Full Prohibition Rule
ENFORCEMENT TIMELINE
Effective May 28, 2024 (phased bans ranging from 6 months to 12 years depending on use)
Overview
This is EPA's final rule under TSCA Section 6 fully prohibiting the manufacture, import, processing, sale, and use of chrysotile asbestos (white asbestos), the only form of asbestos still in commerce in the United States. Phased prohibitions apply to uses including diaphragms for chlor-alkali manufacturing, automotive brake pads, and gaskets.
Enforcement Timeline
March 18, 2024: EPA publishes the final rule
May 28, 2024: The rule takes effect
November 25, 2024: The prohibition on manufacturing, importing, and processing takes effect for automotive brake pads and similar uses
2029–2036: The phased grace period for continued use permits at chlor-alkali manufacturing facilities and similar operations ends
Business Impact
Japanese companies exporting automotive components, industrial gaskets, plant-related parts, and friction materials to the United States must verify and certify the complete absence of chrysotile asbestos across their products and entire supply chain. Violations carry the risk of substantial civil and criminal penalties under TSCA and import detention measures, creating exposure to exclusion from the North American market.
