US TSCA Significant New Use Rules (SNUR)
ENFORCEMENT TIMELINE
Updated on an ongoing basis
Overview
Significant New Use Rules (SNURs) established by EPA under TSCA Section 5(a)(2). The system requires companies to submit a Significant New Use Notice (SNUN) to EPA and complete a 90-day review before manufacturing, importing, processing, or using a designated chemical substance for a use or quantity that qualifies as a "significant new use" (SNU).
Enforcement Timeline
- Issued and effective on an ongoing basis for individual chemical substances (added and designated via the EPA Federal Register)
- After SNUN submission: A 90-day EPA pre-review period (extendable as needed)
- After EPA completes its review (or issues conditional approval or additional testing orders): Manufacturing, import, or use may begin

Business Impact
Companies supplying chemical substances, materials, compounds, and certain articles to the U.S. market must continuously monitor whether the substances they handle are subject to a SNUR designation and whether their proposed uses trigger the designated SNU requirements. Violations are treated as unreported imports and can result in product seizure and substantial civil penalties.
