Disclosure requirements and product bans beginning 2025/2026

Enforcement: Disclosure requirements and product bans beginning 2025/2026

Overview

Minnesota's Amara's Law is one of the strictest PFAS phase-out laws in the nation. It phases in bans on the sale of products containing intentionally added PFAS and, by 2032, bans the use of PFAS in virtually all products except for "currently unavoidable uses." It includes early bans and pre-sale reporting requirements for specific product categories (carpets and rugs, cleaning products, cookware, cosmetics, apparel, etc.).

Enforcement Timeline

- May 24, 2023: Signed into law by the governor

- January 1, 2025: Ban on sale of products with intentionally added PFAS takes effect for 11 specific product categories (cookware, apparel, carpets, cosmetics, etc.)

- January 1, 2026: Detailed reporting of PFAS-containing products sold in Minnesota to the Minnesota Pollution Control Agency (MPCA) becomes mandatory

- January 1, 2032: Full ban on intentionally added PFAS in all products except currently unavoidable uses

Business Impact

Any manufacturer supplying products to Minnesota must fully trace PFAS use in its products and components and transition to PFAS-free alternatives ahead of the 2025 and 2032 deadlines. Failure to comply with reporting requirements or selling banned products can result in substantial civil penalties.
