[Regulatory Update] California CARB Withdraws SB 253 Initial Regulation from OAL Review After Board Approval; Proposes Moving 2026 Reporting Deadline to November 10

At its February 26, 2026 hearing, the California Air Resources Board (CARB) approved the initial regulation implementing SB 253. The regulation establishes a fee component and the first-year reporting deadline; the original deadline for Scope 1 and Scope 2 emissions reports was August 10. On June 24, CARB announced that it had withdrawn the regulation and its associated documents from review by the Office of Administrative Law (OAL) to make limited changes clarifying certain requirements. CARB plans to release those changes for a 15-day public comment period and then resubmit the regulation to OAL. As part of the proposed changes, CARB is also proposing to defer the 2026 Scope 1 and Scope 2 reporting deadline by three months, from August 10 to November 10. The regulation takes effect only after OAL approval.
Editor's View

Under SB 253, companies' climate-related information is no longer purely voluntary ESG reporting but is now tied into a state-level reporting regime. Covered companies need to build not only their own emissions-reporting capability but also a system for obtaining data from their supply chain ahead of future Scope 3 reporting; regulatory compliance requires tracking not only whether a reporting obligation exists, but how the reporting deadline and implementing regulation continue to evolve.
