[Regulatory Update] US EPA postpones start of TSCA §8(a)(7) PFAS reporting to 31 January 2027 — contingent on amendment of the substantive rule

In April 2026, the EPA published a final rule on PFAS reporting under TSCA §8(a)(7), resetting the start of the submission period to 31 January 2027, or 60 days after the effective date of a forthcoming substantive amendment to the rule, whichever is earlier. This does not abolish the reporting requirement itself; it merely resets the timing for the start of data submission. The EPA separately published, in November 2025, a proposal to amend the substance of the rule — including its scope and exemptions — and the two measures should be treated as distinct.

PFAS reporting requires companies to compile historical manufacturing and import records, so a change to the start of the submission period has a direct bearing on the compliance preparation window. Companies need to manage not just the "31 January 2027" date itself but the fact that the actual start date may shift depending on the timing of the separate substantive rule amendment; "postponement of the reporting requirement" and "revision of the requirement's content" should be treated as distinct regulatory events.
