[Regulatory Update] EU expands pollutant controls under water policy — adds PFAS and other substances to surface- and groundwater monitoring
Source:Official Journal of the European Union
Directive (EU) 2026/805 amends the EU's water-related legislation, adding new pollutants to be monitored and managed in surface water and groundwater. The Directive explains that the addition of specific PFAS is prompted by the detection of PFAS in groundwater and by water-related environmental risks not fully captured by the existing list of priority substances.
This is a separate legal route from chemical regulation under REACH. Companies need to recognise that "PFAS as a chemical substance" and "PFAS as a water-environment pollutant" are being addressed in parallel through separate regulatory regimes.
Editor's View
PFAS is being built into the regulatory architecture not only as a substance found in products but also as a pollutant in the water environment. For the chemicals, electronics and manufacturing sectors, wastewater discharge, environmental monitoring and water-quality management around plant sites may become new points of contact for PFAS compliance; the same substance can be addressed by a company through multiple regulatory layers — REACH, water policy and product regulation — simultaneously.
