ASEAN Water & Air Environmental Protection Domain
ENFORCEMENT TIMELINE
Emission standards under continuous strengthening
Overview
An emission management regulatory system overseeing discharge permits and threshold limits for industrial wastewater (BOD/COD standards) from factories/facilities and air pollutants (SOx/NOx) from stationary sources like boilers and chimneys.
Enforcement Timeline
2025: Deadline for installing automatic online monitoring equipment for air emissions and wastewater under the revised Vietnam Law on Environmental Protection.
2026: Tightening of specific industrial wastewater standard thresholds in Thailand.
Related Regulations / Topics
Thailand Industrial Wastewater Standards and Effluent Management Regulations
Industrial wastewater standards and water quality regulations in Thailand are strictly enforced by the Department of Industrial Works (DIW) and the Pollution Control Department (PCD) under the Factory Act and the Enhancement and Conservation of National Environmental Quality Act (NEQA). Following a 2020 notification amendment, the mandatory installation of Continuous Emission Monitoring Systems (CEMS) and the phased application of real-time automated water quality monitoring data reporting came into full operation for major industrial estates and designated establishments in Thailand. All manufacturing plants are required to strictly monitor effluent at discharge points for pH (5.5–9.0), BOD (20 mg/L or below), COD (120 mg/L or below), and heavy metals (lead, cadmium, copper, zinc, mercury, etc.), with strict environmental audits—including suspension orders and fines—applied in the event of non-compliance.
Indonesia Environmental Protection and Management Law (Law No. 32/2009)
This is the basic environmental law (Law No. 32/2009) administered by the Ministry of Environment. It serves as the legal basis for Environmental Impact Assessment (AMDAL), environmental permits, industrial wastewater and air emission standards, and administrative sanctions.
Malaysia Environmental Quality Act 1974
This is the core pollution prevention law administered by the Department of Environment (DOE). It comprehensively regulates industrial effluent, air emissions, industrial waste, and noise, and operates a licensing system with strict legal penalties for non-compliant operators, alongside an EIA regime.
Philippines Clean Air Act (RA 8749)
This is the basic air quality law (RA 8749) administered by the Department of Environment and Natural Resources (DENR). It regulates air pollutant emissions from stationary sources (such as boilers and manufacturing equipment) and mobile sources, and manages the Permit to Operate system.
Philippines Clean Water Act (RA 9275)
This is the basic water quality law (RA 9275) administered by the Department of Environment and Natural Resources (DENR). It sets standards for the discharge of factory effluent into water bodies, operates the Discharge Permit system, and defines the required level of wastewater treatment for facilities.
Singapore Environmental Protection and Management Act (EPMA) – Air and Water Management
This is the core industrial pollution prevention law overseen by the National Environment Agency (NEA). It strictly manages permits and limit values for stationary-source air pollutants (SOx/NOx) and industrial wastewater (BOD/COD standards) from factories and business premises.
Thailand Enhancement and Conservation of National Environmental Quality Act (NEQA) – Air and Water Standards
This is the basic environmental law implemented in practice by the Pollution Control Department (PCD) under the Ministry of Natural Resources and Environment. It sets factory effluent standards, air emission limit values, and Environmental Impact Assessment (EIA) procedures, and conducts regular inspections and permit management for business establishments.
Vietnam Law on Environmental Protection – Water and Air Emission Controls
Under the Law on Environmental Protection (LEP 2020), administered by the Ministry of Agriculture and Environment, this comprehensively sets out requirements for manufacturing plants regarding wastewater and air emission management, obtaining environmental licences, and the installation and administrative connection obligations for automated online environmental monitoring equipment.
Business Impact
Manufacturing and processing plants operating in ASEAN must maintain treatment facilities that satisfy national industrial estate discharge and exhaust emission regulations.
