EU CLP Regulation — New Hazard Classes (ED, PBT/vPvB, PMT/vPvM) and Classification and Labelling Obligations
ENFORCEMENT TIMELINE
In force since April 20, 2023 (mandatory application from May 1, 2025 for substances and May 1, 2026 for mixtures)
Overview
Delegated Regulation (EU) 2023/707 adds four new hazard classes to the CLP Regulation: endocrine disruptors (for human health and the environment), persistent, bioaccumulative and toxic substances (PBT/vPvB), and persistent, mobile and toxic substances (PMT/vPvM). Chemical substances and mixtures meeting these criteria must carry the corresponding new EUH hazard statement codes on labels and in safety data sheets.
Enforcement Timeline
April 20, 2023: The delegated regulation enters into force.
May 1, 2025: Mandatory application of the new classification and labelling requirements begins for new individual substances (a grace period for substances already on the market ends November 1, 2026).
May 1, 2026: Mandatory application begins for new mixtures (a grace period for existing mixtures ends May 1, 2028).
Business Impact
Manufacturers of chemicals and articles involving PFAS-related substances, surfactants, and additives need to reassess whether their substances meet the new hazard class criteria based on the latest data, and revise safety data sheets and reprint product labels accordingly.
