EU REACH Universal PFAS Restriction Proposal
ENFORCEMENT TIMELINE
Under review by ECHA's scientific committees (RAC final opinion adopted March 3, 2026; SEAC final opinion expected by end-2026; adoption timing not set)
Overview
The "Universal PFAS Restriction Proposal" under the REACH Regulation is a landmark restriction proposal that, using a broad definition of PFAS (any substance containing at least one fully fluorinated methyl or methylene carbon atom), would in principle ban the manufacture, import, placing on the market, and use of more than 10,000 substances across the EU.
The proposal sets either a full ban (with only an 18-month transition period) or time-limited, use-specific derogations (of 5 or 12 years) for particular applications. Even industries where no substitute currently exists — such as medical devices, semiconductor manufacturing, hydrogen energy, and vehicle batteries — would only receive transitional measures with a set expiry.
Enforcement Timeline
January 13, 2023: Five European countries (Germany, the Netherlands, Denmark, Sweden, and Norway) submit the restriction proposal to ECHA.
March–September 2023: A public consultation is held.
2024–2025: The Committee for Risk Assessment (RAC) and the Committee for Socio-Economic Analysis (SEAC) deliberate sector by sector and compile final opinions.
March 3, 2026: ECHA's Committee for Risk Assessment (RAC) adopts its final opinion.
March 26, 2026: ECHA publishes the SEAC draft opinion and opens a 60-day consultation (until May 25, 2026).
By end-2026 (expected): SEAC adopts its final opinion (meeting of November 17–19, 2026).
After both opinions: the European Commission proposes a restriction for discussion and vote in the REACH Committee; adoption timing is not set.
Business Impact
Companies across all supply chains need to fully map their use of fluoropolymers (such as PTFE, PVDF, and PFA), fluoroelastomers (FKM), fluorinated solvents and cleaning agents, and surfactants in their products and manufacturing processes, and urgently advance the development and validation of non-fluorinated alternatives.
