Enforcement: Full application from June 20, 2025

Overview

This is an individual implementing regulation (Regulation (EU) 2023/1669) issued under the previous Ecodesign Directive (2009/125/EC). It applies to smartphones and tablets sold on the EU market, covering energy efficiency, battery durability (charge-discharge cycle count), robustness against drops and water exposure, and the right of users and independent repairers to access spare parts. It functions as a transitional design ahead of full ESPR coverage.

Business Impact

Electronics manufacturers exporting smartphones, tablets, and portable smart devices to the EU market must meet drop-durability testing, dust and water resistance of at least IP67, and battery durability requirements ensuring at least 80% capacity retention after 800 charge-discharge cycles.

For at least seven years after a product is discontinued from the market, manufacturers must continue supplying key spare parts (batteries, displays, back covers, and others) to repairers and consumers at a reasonable price, increasing parts sourcing and inventory costs. Manufacturers are also legally required to continue providing OS updates and security patches for five years after a product's final placement on the market. From June 2025, products that fail to meet these design requirements or energy labeling rules are fully barred from import and sale in the EU, entailing a significant loss of business opportunity.
